The German Plant Protection Act governes that the German Federal Office of Consumer Protection and Food Safety (BVL) must involve the Julius Kühn Institute (JKI), the German Federal Institute for Risk Assessment (BfR) and the German Federal Environment Agency (UBA) in procedures for authorisation of plant protection products. In his essay, lawyer Peter Koof examines the question of whether, in the event of non-compliance with the deadlines pursuant to Regulation (EC) No. 1107/2009, the BVL is entitled and obliged to carry out the examination itself instead of the involved authorities.
